Welcome to balipmavisa.com! These Terms of Service (“Terms”) govern your access to and use of the services provided by Bali PMA Visa (“We,” “Our,” or “Us”), an Indonesia visa consulting service. By accessing, browsing, or using our website and services, you (“Client,” “You,” or “Your”) agree to be bound by these Terms and our Privacy Policy. Please read them carefully before engaging our services. If you do not agree with any part of these Terms, you must not use our services.
1. Scope of Service
Bali PMA Visa provides professional consulting and facilitation services to assist clients in navigating the complex process of obtaining Indonesian visas, permits, and related legal documents, specifically focusing on PMA (Penanaman Modal Asing / Foreign Direct Investment) visas and other relevant immigration pathways. Our services include, but are not limited to, expert advice, document preparation assistance, application submission guidance, liaison with relevant Indonesian government agencies, and status monitoring.
Crucially, our role is to facilitate and guide the application process. We explicitly state that Bali PMA Visa does not guarantee the approval of any visa, permit, or application by the Indonesian government or any of its agencies. The final decision on all applications rests solely with the respective government authorities, and their decisions are outside our control. We are not responsible for government policy changes, processing delays, or rejections. Our commitment is to provide accurate information and diligent support based on current regulations and our expertise.
2. Client Responsibilities
As a Client, you agree to:
- Provide accurate, complete, and truthful information and documentation required for your application in a timely manner.
- Cooperate fully with our team, respond promptly to requests for information, and attend any necessary appointments.
- Understand that any incorrect or misleading information provided by you may lead to application rejection or other legal consequences, for which Bali PMA Visa bears no responsibility.
- Be aware that government processing times can vary significantly and are subject to change without notice.
3. Fees and Payments
Details of our service fees will be provided to you in a separate proposal, service agreement, or invoice, which will outline the specific services covered. All fees are quoted in IDR or USD, as specified, and are due as per the payment schedule outlined in your agreement. Payments can be made via bank transfer or other methods as agreed upon. Please note that our service fees do not include government application fees, embassy fees, translation costs, notary fees, legalisation fees, or any other third-party charges, which will be your sole responsibility unless explicitly stated otherwise in your service agreement. All payments are non-refundable once services have commenced, unless otherwise stated in our Refund Policy.
4. Refund Policy
Our comprehensive Refund Policy is available upon request and forms an integral part of these Terms. Clients are encouraged to review this policy before engaging our services. Generally, fees for services rendered are non-refundable. Refunds, if any, will be processed strictly according to the terms and conditions outlined in our Refund Policy, taking into account the stage of service completion and any non-recoverable costs incurred by Bali PMA Visa.
5. Limitation of Liability
To the maximum extent permitted by law, Bali PMA Visa, its directors, employees, agents, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
In no event shall our total liability to you for all damages, losses, and causes of action (whether in contract, tort, including but not limited to negligence, or otherwise) exceed the amount paid by you to Bali PMA Visa for the specific services giving rise to the liability. We are not liable for any losses or damages arising from the denial, delay, or refusal of any visa, permit, or application by the Indonesian government or any third-party authority.
6. Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall first be attempted to be resolved amicably through good faith negotiations between the parties. If an amicable resolution cannot be reached within a reasonable time, the parties agree that such dispute shall be exclusively settled by the competent courts located in Bali, Indonesia.
7. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond its reasonable control (“Force Majeure Event”).
